Now as regards this Company, it could have carried out what it desired in Hong Kong by appointing persons to act as Trustees on its behalf, or by registering a Company in Hong Kong, because the appointment of a Trustee need not necessarily be under seal, and & Company if registered in Hong Kong would probably have full power to deal in land. The Mortmain Acta it should be remembered do not apply there.
In any event the third paragraph in the proposed Ordinance seems to me, however convenient, to be too wide, because I should assume that it is not intended to relieve foreign Corporations which can and do use seals from appointing under seal their representatives in Hong Kong to act for them. only be given in the case where the lawe of their countries do not
The relief should require them to use a seal. Bút a point of principle is at stake, and I think the matter should be referred to the Law Officers and Junior Counsel for advice.
